User terms

Please read this agreement carefully as it governs your use of the: apricotlearningonline.co.uk, apricotlearningzone.co.uk, apricotlearningextra.co.uk websites (together, the ‘sites’). By continuing to use the sites you are agreeing to the terms that appear below. Some of the services on the sites are free to access and others are only available on a paid for basis (‘subscription services’). Part A applies to all services; Part B applies only to the free subscription services, Part C applies only to the online job application service. Part A: General terms

1. Provision of service

a) The sites are owned and operated by Apricot Online Ltd (company number 07568449), whose registered office is at 3 Fairview Court, Fairview Road, Cheltenham, Gloucestershire GL52 2EX (‘Apricot Online’). If you are accessing the sites under your school's subscription arrangement, the terms agreed on behalf of your school will apply and will prevail over this agreement.

2. Limited rights to use content

a) All material displayed on the sites (‘content’) belongs to Apricot Online or its licensors. Subject to clause 2.b, you may retrieve and display the content on a computer screen, print individual pages on paper and store such pages in electronic form on disk (but not on any server or other storage device connected to an external network) for your own personal, educational, non-commercial purposes.

b) Most of the content on the sites is owned by apricotlearningonline.co.uk but certain content is used under licence from third parties (‘third party content’) and will be marked with the copyright notice of those third parties. Some of the third party content will be subject to additional restrictions - the relevant copyright notice will make it clear where that is the case. You must comply with such restrictions. Every effort has been made to trace all the copyright holders, but if any have been inadvertently overlooked, Apricot Online will be pleased to make the necessary acknowledgements at the first opportunity.

c) You may not (without prior written permission from apricotlearningonline.co.uk):

  • redistribute any of the content or supply it to other people (including by using it as part of any library, archive, intranet or similar service);
  • remove the copyright or trade mark notice from any copies of content made under this agreement;
  • create a database in electronic or structured manual form by systematically downloading and storing all or any of the content;
  • except as expressly set out above, modify, reproduce or in any way commercially, exploit any of the content.

3. Limited warranties

a) Apricot Online will use its reasonable skill and care in making the sites available to you and in ensuring their continuing availability. However, because of the number of sources from which Apricot Online obtains the content and because of the nature of the internet, Apricot Online does not give you any other warranties. In particular, you should not take the accuracy or availability of the information for granted and Apricot Online makes no warranty that the sites are free from infection by viruses or anything else that has contaminating or destructive properties.

4. Limitation of liability

a) In respect of the content which is available free on the sites, Apricot Online will use its reasonable endeavours to resolve faults but because this content is free you agree that Apricot Online will not be liable for any losses you may incur as a result of your use or non-use of that content. With regard to the subscription services, you agree that your exclusive remedy (in respect of any claim for breach of contract, negligence or otherwise) shall be limited to Apricot Online taking reasonable steps to correct the relevant subscription service or, at your option, a refund of the amount you have paid to Apricot Online to receive the relevant subscription service less any reasonable allowance for your receipt of the functioning service.

b) Apricot Online does not accept any liability for any loss of profits, loss of business or business opportunity, loss of goodwill or reputation, business interruption, loss or corruption of data or programs or any type of indirect or consequential loss whatsoever arising from your access to and use of the sites and/or of any purchase of the subscription services nor for its being unable to fulfil any particular order due to the non-availability of the subscription services.

c) In no event will Apricot Online be liable for any losses or damages whatsoever arising out of, or in connection with, any unauthorised use of the sites and/or of any material published on them and/or of any services.

d) No assurances are given that the pages of the sites are free from infection from computer viruses, although Apricot Online takes all reasonable steps to prevent such infection.

5. Privacy policy

a) The information that you provide about yourself to Apricot Online will only be used by Apricot Online in accordance with its privacy policy (see below). Please read the privacy policy carefully and if you have any questions please email info@apricotlearningonline.co.uk.

6. Changes

a) Apricot Online is continually seeking to improve the sites and services offered. Apricot Online reserves the right, at its discretion, to make changes to any part of the sites. In respect of any subscription services, we will ensure that any changes do not materially decrease the functionality of those services.

b) In respect of non-subscription services, Apricot Online may change or add to this agreement as a result of its policy of updating and improving the sites or for security, legal or regulatory reasons. Apricot Online will give you notice of any changes or additions. If you do not agree to be bound by those changes, you should not use the site any further after receiving notice. Such changes will not affect any contract that relates to ongoing subscription services that you have with Apricot Online at the time of the changes.

7. Links

a) The sites contain links to other websites and resources (either directly or through frames) and, where possible, Apricot Online will make clear where such links are being made. Independent third parties provide these sites and Apricot Online is not responsible and shall not be liable for the availability or content of these outside resources.

8. General

a) In respect of the free parts of the sites, there is no specific time limit applying to your access and use. However, Apricot Online reserves the right to suspend or terminate your access and use of the free parts of the sites at any time. It may exercise the right with or without notice.

b) You may not assign, sub-licence or otherwise transfer this agreement or your rights of access to the sites.

c) Failure by either party to exercise any right or remedy under this agreement does not constitute a waiver of that right or remedy.

d) A person who is not party to this agreement shall have no right under the contracts (Rights of third parties) act 1999 to enforce any of its terms.

e) English law will apply to this agreement and both you and Apricot Online agree to submit to the non-exclusive jurisdiction of the English courts.

Part B: Privacy policy

9. Information collected

a) It is necessary for Apricot Online to collect your personal information (including name and email address) for the purposes of registering you as a user of the sites, to provide and administer the services, to inform you of suitable products and services offered either by Apricot Online or by other AQA group companies, and for market research. Your responses also help us to provide as complete a service as possible for you by ensuring that the sites and any appropriate advertising space that we sell reflects your needs and requirements.

b) If your contact details change please amend details in the ‘edit your details’ section.

c) Apricot Online collects data listing which of Apricot Online’s pages are most frequently visited and by which type of users.

10. Data protection and disclosure

a) Apricot Online maintains registrations and takes all reasonable endeavours to comply with all requirements of the UK Data Protection Act 1998 and any regulation created under it.

b) Your information may be passed to and used by other AQA companies for the purposes set out above. Apricot Online will not disclose any of your personal information to any other third party (other than agents working directly on our behalf either in the UK or abroad including, without limitation, those third parties providing payment processing services or IT hosting services) except with your permission or where Apricot Online is required to do so by law. Apricot Online will use its best efforts to ensure that these third parties process data on Apricot Online’s behalf. Apricot Online endeavours to take sufficient measures to ensure the safety of your personal data.

c) You may request details of personal information which Apricot Online holds about you under the data protection act 1998. On payment of a standard fee of £10 Apricot Online will share that information with you within 40 days. You are also entitled to ask Apricot Online to correct any inaccuracies in any of the data it holds about you. 11. Further use of information

a) Apricot Online may occasionally send you communications about products and services that it feels may be of interest to you unless you indicate that you are not interested in receiving such offers or information from us.

b) Save as provided at 14(b) above, Apricot Online does not sell, trade or rent user information to others unless you have given permission.

c) Apricot Online will share aggregate statistics about sales and traffic patterns with our advertisers, but these statistics will not include any personally identifiable information.

12. Cookies

In addition to the information which you supply when you register with Apricot Online, information and data may be automatically collected through the use of cookies. Cookies are small text files a website can use to recognise repeat users and allow Apricot Online to observe behaviour and compile aggregate data in order to improve the Site. Cookies make it possible for Apricot Online to identify registered users without needing to ask for registration details every time you access the site. Using cookies also means that accessing the site is more convenient for you as you do not need to remember your username and password each time you enter the site.

13. Apricot Online’s security policy

a) No data transmission over the Internet can be guaranteed to be 100% secure. As a result, while Apricot Online strives to protect your personal information, we cannot ensure or warrant the security of any information you transmit to Apricot Online and you do so at your own risk.

b) Following transmission, Apricot Online will make best efforts to ensure the security of the information on its systems.

At Apricot Online we collect information about our users for two main reasons:

  1. To help us continually improve the service we offer.
  2. To use the details of our users to sell appropriate advertising space on the site, and so continue to keep a proportion of the sites free for all our users.

14. Privacy policy – final points

We are absolutely committed to protecting your privacy and have established the following principles:

a) We will respect your email privacy, and will send you unsolicited mail from Apricot Online only if you have not advised us that you do not wish to receive it.

b) Save as outlined above, we will not pass on any individual user details (including your email address) unless we have your prior consent.

c) Otherwise, we will only share aggregate statistics about our users, sales and traffic patterns with our advertisers.

Part C: Recruitment Services Policy

15. Schedule

You can access our home page and browse our site without disclosing your personal data save information collected by cookies that we use (see below).

16. Who may process data

Your personal information (which includes your name, address and any other details you provide to us which concern you as an individual) may be processed only by us. Processing your information as mentioned above will be done in accordance with our privacy policy and with your authorisation by email in each case.

17. Purpose of processing

We will use your information for the purpose of matching CV details to educational vacancy requirements, processing any other transactions authorised or made by you with us, and undertaking product or customer research/development.

18. Disclosure of Information

In the unlikely event that a liquidator, administrator or receiver is appointed over us or all or any part of our assets that insolvency practitioner may transfer your information to a third party purchaser of the business provided that purchaser undertakes to use your information for the same purposes as set out in this policy. We undertake not to provide your personal information to third parties save in accordance with this policy.

19. Cookies

A cookie is a small piece of information created by your browser using information sent from a website so it can later be read back from that browser. This is useful for having the browser remember some specific information. When you visit some areas of our website, a temporary cookie may be used. The cookie is only active during your current visit to our website and is not stored on your computer`s hard drive. We use a temporary cookie to verify who you are while using our website, this cookie can only be used by our website. Cookies cannot be executed as code or deliver viruses. In order to access some areas of our site you must have cookies enabled.

20. Security measures

We have implemented security policies, rules and technical measures to protect the personal data that we have under our control from unauthorised access, improper use and disclosure, unauthorised destruction or accidental loss.

21. Access to information

You may ask us whether we are storing personal information about you by emailing us at info@apricotlearningonline.com and, if you wish, we will provide you with a copy of the personal data we hold about you by email. We may ask for proof of your identity before providing any information and reserve the right to refuse to provide information requested if identity is not established.
